Terms and Conditions

1)The normal trading terms of Barcode Direct Pty Ltd are COD payment by Cash, Cheque or Direct Deposit. Credit Card payment is accepted on a COD account at no extra charge but a 2.5% charge will apply when paying credit accounts by credit card.

2)A credit facility may be provided to approved Purchasers only, following submission of a complete Credit Account Application with at least three commercial references. It is understood that any credit facility which may be granted to the Purchaser is granted only at their request and in consideration that the credit account applicant personally guarantees payment of all sums payable by the Purchaser to Barcode Direct Pty Ltd.

3)The Purchaser acknowledges and agrees that the terms of payment are “Strictly 30 days from the date of the Invoice”. In the event the account becomes overdue, Barcode Direct Pty Ltd reserves the right to charge interest in accordance with the Penalty Interest Rates Act 1983.

4)Barcode Direct Pty Ltd, at its discretion, reserves the right to refer any overdue accounts to a mercantile agency or a solicitor for collection and recovery action and the Purchaser agrees to be responsible to meet all reasonable costs and commissions incurred in employing a mercantile agent or solicitor to collect any overdue amount.

5)The Purchaser agrees that Barcode Direct Pty Ltd may seek consumer credit information (Section 20C, Privacy Act 1988). If Barcode Direct Pty Ltd considers it relevant to assess Purchaser’s application for commercial credit, Purchaser agrees to Barcode Direct Pty Ltd obtaining from a credit reporting agency a credit report containing personal credit information about Purchaser in relation to commercial credit to be provided by Barcode Direct Pty Ltd to Purchaser.

6)The Purchaser must inform Barcode Direct Pty Ltd, in writing, within seven (7) days, of any change in Purchaser’s business or corporate structure.

7)Barcode Direct Pty Ltd reserves the absolute right to refuse or withdraw the Purchaser’s credit facilities at any time in its sole discretion.

8)All contracts between Barcode Direct Pty Ltd and the Purchaser shall be deemed to have been entered into in the State of New South Wales and shall be construed according to the laws of the State of New South Wales.

9)Barcode Direct Pty Ltd reserves the following rights in relation to any goods provided to the Purchaser by Barcode Direct Pty Ltd, until all monies owed by the Purchaser to Barcode Direct Pty Ltd for those goods are fully paid:

a)legal ownership of the goods remains with Barcode Direct Pty Ltd:
b)Barcode Direct Pty Ltd or its appointed agent may enter the Purchaser’s premises (or the premises of any associated company or agent where the goods are located) without liability for trespass or any resulting damage, and retake possession of the goods: and
c)Barcode Direct Pty Ltd may keep or resell any goods repossessed pursuant to (b) above:
i)If the goods are resold, or products manufactured using the goods are sold, by the Purchaser, the Purchaser shall hold such part of the proceeds of any such sale as represents the invoice price of the goods sold or used in the manufacture of the goods sold in a separate identifiable account as the beneficial property of Barcode Direct Pty Ltd and shall pay such amount to Barcode Direct Pty Ltd upon request.
d)Notwithstanding the provisions above, Barcode Direct Pty Ltd shall be entitled to maintain an action against the Purchaser for the purchase price and the risk of the goods shall pass to the Purchaser upon delivery.

10)Any signatory for a proprietary Company Purchaser shall be personally liable for the due performance of the Purchaser’s obligations as if the signatory was the Purchaser.

11)Orders placed with Barcode Direct Pty Ltd and accepted by Barcode Direct Pty Ltd will be accepted strictly subject to these Terms and Conditions of sale and the placing of such orders shall be conclusive of the fact that the Purchaser has read, understands and agrees to such conditions of sale.

12)Delivery shall be made to the location specified on the Purchaser’s order and the Purchaser shall be liable for all freight and handling charges.

13)Barcode Direct Pty Ltd will endeavour to fill all orders promptly but will not be liable in respect of any delay occurring in the supply of the goods and/or services or any loss or costs the Purchaser may suffer as a result. Barcode Direct Pty Ltd shall not be liable for indirect or
consequential loss or any loss to Purchaser(s) due to the delay.

14)Claims for short delivery or goods damaged in transit must be made in writing to Barcode Direct Pty Ltd within seven (7) days from the date of invoice. Claims after this period will be rejected by Barcode Direct Pty Ltd.

15)Barcode Direct Pty Ltd offers Warranty on all new Hardware supplied, for use in Australia only. This warranty does not extend to accessories or defects or injuries caused by or resulting from causes not attributable to faulty parts or the manufacture of the product,
including but not limited to, defect or injury caused by or resulting from misuse, abuse, neglect, accidental damage, improper voltage, liquid spillage, pest infestation, software or any alterations which are not authorised by Barcode Direct Pty Ltd. Warranty repairs are to be returned to Barcode Direct Pty Ltd for repair, insurance and freight prepaid, with appropriate paperwork including a copy of original invoice and completed Returns Authorisation form. Please contact our Sales Department to confirm the warranty period on particular products. The Purchaser acknowledges that Barcode Direct Pty Ltd is a distributor not a manufacturer and the warranty offered by Barcode Direct Pty Ltd reflects the warranty offered by the manufacturer. Goods returned to Barcode Direct Pty Ltd as a part of a warranty claim shall be on forwarded by Barcode Direct Pty Ltd to the manufacturer for assessment and either rejection of the warranty claim or repair or replacement in accordance with the manufacturer’s warranty.

16)If Barcode Direct Pty Ltd inspects and quotes on a chargeable repair and that quote is not accepted by the customer, a ‘Quote Fee’ of $90 excluding GST will be applicable and become due and payable by Purchaser. Barcode Direct Pty Ltd has a minimum service charge of 1 hour on all repairs carried out by the Barcode Direct Service Centre. If a repair is not collected from the Barcode Direct Service Centre within 90 days from the book-in date, then Barcode Direct Pty Ltd holds no responsibility for the equipment after this time.

17)Barcode Direct Pty Ltd requests that all Purchase Orders be emailed to our Sales Department email: sales@barcodedirect.com.au. No responsibility is taken for errors with any orders placed by telephone. A 25% restocking fee or complete refusal of claim will apply to any errors with telephone orders.

18)Barcode Direct Pty Ltd is committed to exceptional customer service, and therefore undertakes that any despatch errors caused by Barcode Direct Pty Ltd will be collected and credited without question. Barcode Direct Pty Ltd also understands that Purchasers are often asked to accept returns from their customers for a variety of reasons outside Barcode Direct Pty Ltd’s control. To this end we are happy to assist Purchasers by taking back standard stock line goods within a seven (7) day period after deducting a 25% restocking fee. If goods have been ordered from a Supplier specifically for the Purchaser then Barcode Direct Pty Ltd will not accept these goods for credit return. Goods are to be returned to Barcode Direct Pty Ltd, insurance and freight prepaid, along with a copy of the Original Purchase Invoice. Goods must be returned to Barcode Direct Pty Ltd complete (instruction manual, packaging and all supplied accessories) and be in full resaleable condition. Damage to, or markings on the original packaging may deem the products unsaleable, therefore the claim will be rejected. A completed Returns Authorisation form must accompany all returns. Credit will NOT be issued for the freight content of the original invoice. No refund can be issued but will be credited against the client account.

19)Non-standard orders cannot be cancelled once placed with Barcode Direct Pty Ltd and the Purchaser must accept delivery of the goods within seven (7) days of Barcode Direct Pty Ltd advising the Purchaser of the availability of the goods for delivery.

20)Where goods have been supplied for evaluation by Purchaser, Purchaser agrees to return them to Barcode Direct within 30 days of the Evaluation Invoice date. Goods will not be accepted for return if they are returned after that time. Goods that are returned within the Evaluation period will be subject to a 25% fee if they are not returned complete (with instruction manual, packaging and all supplied accessories) and are not in full resaleable condition.
